THE CLAIM FORM - STARTING YOUR LEGAL ACTION

I have seen, and have assisted with, numerous cases since I started my business, where the claimant had issued Court Proceedings but the defendant (or the Judge) had contested the claim, citing issues with the Claim Form. Probably the most common error I have seen is insufficient information given in the Particulars of Claim, or even (not infrequently) this section left completely blank.

Some such issues can lead to your case being struck out, meaning, at best, you must start again, and at worst, you end up paying costs incurred by the defendant on the grounds of unreasonable behaviour, and of course another court fee.

Furthermore, even if your Claim Form is free of errors, if you do not include in your Claim Form and Particulars of Claim all arguments you intend raising in your case, you cannot raise them later at Trial.

It is critical that you get this right at the start.
